SUBJECT: New Academic Personnel Policy 390, Postdoctoral Scholars, to Be Implemented in Three Stages Beginning July 1, 2003

Enclosed is a new academic personnel policy APM 390 (Postdoctoral Scholars). The policy will be implemented in three stages starting July 1, 2003. Details are provided in the enclosed Transition Guidelines, which have been attached formally to APM 390 as Appendix A.

The development of this policy was undertaken in response to national and University of California discussions and reports on postdoctoral education over the past five years. During the formal Universitywide review of this policy, comments were received from the campuses, the Academic Council and Senate committees, several UC postdoctoral scholar associations, and the Office of General Counsel.

Three principal issues emerged from the formal review. First, adequate flexibility was requested with respect to the provision limiting postdoctoral service to a maximum of five years, including postdoctoral service at other institutions. The final policy adds a new provision to permit exceptions for a sixth year. Second, with respect to flexibility regarding minimum salary/stipend and 100% time requirements, the policy retains its strict provisions in view of the need to provide salaries and stipends at levels commensurate with Postdoctoral Scholars' educational background and qualifications and to recognize that the postdoctoral experience is essentially full time. Third, the new policy provides for no vacation accrual and offers a provision for time off during the academic-year intersession and break periods (which constitute about four weeks excluding holidays) or at alternative times to be arranged by the Postdoctoral Scholar and mentor.

The new policy applies to (1) postdoctoral employees funded from research grants; (2) postdoctoral fellows and trainees funded from fellowships or traineeships paid through University accounts; and (3) postdoctoral fellows and trainees funded from fellowships or traineeships paid directly to the individuals by extramural agencies.

The University is currently developing a new Postdoctoral Scholars benefits package that will provide medical, dental, and vision care, and certain other benefits. These plans will become operative January 1, 2004. Information about the new benefit plans will be provided in Fall 2003.

The new policy will be implemented in three stages on the Irvine campus:

1. On July 1, 2003, the policy provisions on the minimum salary/stipend*, 100% appointments, and the five-year limit on time in postdoctoral status (with extensions up to a sixth year possible) take effect for new postdoctoral scholar appointments; and the provisions on annual reviews, grievances, layoffs, and corrective action and dismissal take effect for all postdoctoral scholars.
  * The Irvine campus has established a minimum salary range/stipend of $31,044, based on the current Postgraduate Researcher, Step I, salary.
2. New appointment and reappointment procedures will be implemented for all three new titles and will be forthcoming shortly.
    The new titles and title codes for Postdoctoral Scholar-Fellow (3253) and Postdoctoral Fellow-Paid Direct (3254), will be available July 2003.
    The new title and title code for Postdoctoral Scholar-Employee (3252) will be available January 2004.
3. Effective January 1, 2004, the new sick-leave and time-off provisions and a new Postdoctoral Scholars benefits package will take effect.

In addition, certain "grandfather" provisions, described in the enclosed Transition Guidelines, apply to continuing Postdoctoral Scholars.
