RE: Ratification of Non-Senate Instructional Faculty Unit MOU (Unit 18)


This is to inform you that the University has received formal notice from the University Council - American Federation of Teachers (UC-AFT) that the UC-AFT has ratified the agreement that was reached between the parties during the 2005 reopener negotiations for the Non-Senate Instructional Faculty Unit (Unit 18). The current Memorandum of Understanding (MOU) between the parties became effective on August 25, 2005, and will expire on August 24, 2010.

The following is a summary of the agreement:

1. Article 7 - Appointments

The University will allow pre-six Lecturers who do not have a Continuing appointment to request a one-time allocation of additional credit for quarters taught in other departments on the same campus. The AFT is responsible for notifying the Lecturers of this opportunity. Specific details are outlined in Appendix H of the MOU which is attached. Questions concerning the details of this program should be directed to Academic Personnel.

Pre-six Lecturers will receive a salary adjustment of at least two increments upon reappointment to a fourth year (or tenth quarter) of service. The previous MOU provided a salary increase of one increment.

Letters of appointment for pre-six Lecturers who have academic year appointments will need to be issued by June 15th of each academic year or as soon as practicable. Departments will need to process renewals and new appointments before the end of Spring Quarter.

2. Article 17 - Layoff, Reduction in Time, and Reemployment

The reemployment time (preferential rehire status) for Continuing Lecturers was reduced from three years to two years.

3. Article 22 - Merit Review Process

The University agreed to provide merit review guidelines to the AFT for each campus.

The standard of performance to be used in merit reviews for Continuing Lecturers will remain "excellence."


4. Article 40 - Duration

The current contract will expire on August 24, 2010.

The parties will engage in reopener negotiations in October, 2006, on Article 21-Salary and Article 24- Instructional Workload. In addition, each party may select one additional article to reopen. Article 11-Benefits cannot be selected for this reopener.

The parties will engage in reopener negotiations in October, 2008, and each party may select up to three articles for the negotiations.


Copies of the revised MOU are currently being printed and will be distributed later this Fall. Please contact your Academic Personnel Analyst if you have any questions regarding the changes in the MOU.
